Moldova: A compatible registry for bareboat registration (both In and Out)

Yesterday, Tuesday 7th January 2014, Malta’s Minister responsible for Shipping approved the Moldavian maritime registry as a compatible registry with Malta’s Ship Registry for the purposes of parallel registration of vessels, subject to the conditions of bareboat charter registration.   

 

According to Maltese Merchant Shipping Act bareboat charter means the contract for the lease or sub-lease of a ship for a stipulated period of time, by virtue of which the charterer shall acquire full control and complete possession of the ship, including the right to appoint the master and crew for the duration of the charter but excluding the right to sell or mortgage the ship. The charterer, during the period in which he is registered as a bareboat charterer, is also entitled to register the vessel flying the Maltese flag in another foreign State, parallel registration, as long as the foreign registry is approved by Malta’s Minister responsible for Shipping.

 

Upon termination of the bareboat charter the vessel will revert again under the Maltese flag (the underlying flag) since Malta is the State in which the said vessel is registered by its owners. The compatibility of the laws of the foreign State with the Maltese Shipping Legislation is taken into consideration in order for the Minister responsible for Shipping in Malta to be able to approve the foreign registry as a compatible one under the provisions of article 84B of Merchant Shipping Act.
